Terms of Service

By purchasing any service from DBlack Marketing (“DBM”), you agree to the following terms:
1. Services Provided
DBM provides managed digital marketing services including Website Design (LazySites), Social Media Management (Klixsy), Reputation Management (LocalRevue), and AI Chatbots (Chattica AI)
2. Data Processing Agreement
When DBM processes personal data (such as leads or customer lists for review requests) on your behalf, you (the Client) are the Data Controller and DBM is the Data Processor.
Client Responsibility: You must ensure you have the legal right (consent or legitimate interest) to contact the individuals whose data you provide to us for review requests or marketing automation.
DBM Responsibility: We will process data only to provide the services requested and will maintain appropriate security measures.
3. SMS & Email Communications
We collect information you provide when you purchase a plan, contact us, or use our client portal, including:
- Lead Alerts: We will route enquiries to you via the contact methods provided.
- Review Requests: Our software sends messages on your behalf. You are responsible for ensuring these communications comply with local regulations and that your customers have not opted out of such communications.
4. Payments & Cancellations
Services are billed on a subscription or one-time basis as stated at checkout.
- No Contracts: You may cancel your service at any time. No further billing will occur after cancellation, and services will terminate at the end of the current billing period.
- Refunds: Due to the "done-for-you" nature of our setup and services, payments are generally non-refundable once work has commenced.
5. Limitation of Liability
DBM provides tools and management to help grow your business, but we do not guarantee specific results, lead volumes, or star ratings. DBM is not liable for any indirect losses or data breaches caused by third-party infrastructure providers.
6. Governing Law
These terms are governed by the laws of England and Wales.
